Terms of Service

Effective Date: September 23, 2026

These Terms of Service (“Terms”) govern purchases made through https://airsurfer.co/ and related AirSurfer services.

The contracting party is AirSurfer LLC, a limited liability company organized under the laws of the State of Wyoming, United States (“AirSurfer,” “we,” “us,” or “our”).

By submitting an Order and accepting these Terms, you enter into a binding agreement with AirSurfer LLC.

1. Definitions

“Order” means the Service, traveler information, itinerary, plan, price and other conditions displayed and accepted at checkout.

“Reservation Record” means a temporary electronic reservation record created through an airline, reservation system, GDS, travel supplier or other third-party system. A Reservation Record may include a PNR, itinerary and related booking information.

“Minimum Service Period” means the minimum period stated in the purchased plan during which the Reservation Record is intended to remain available, subject to the replacement provisions below.

Where a plan is expressed as a range, such as 5–7 days, the lower number is the Minimum Service Period and the upper number is an estimate unless expressly stated otherwise.

“Material Itinerary Requirements” means:

  • traveler identity;

  • origin;

  • destination;

  • travel date; and

  • any other parameter expressly identified as guaranteed during checkout.

Unless expressly identified as guaranteed, the airline, operating carrier, flight number, departure or arrival time, booking class, supplier, reservation system and PNR are not Material Itinerary Requirements.

2. Scope of the Service

AirSurfer provides travel-related assistance services, which may include arranging temporary flight Reservation Records, accommodation reservations and visa or travel-document assistance.

The exact Service, price, processing time, Minimum Service Period and other material conditions are displayed before payment and form part of the Order.

AirSurfer may use airlines, accommodation providers, reservation systems, GDS providers, travel suppliers and technology providers to perform an Order.

Unless expressly stated otherwise, AirSurfer is not an airline, accommodation provider, embassy, consulate, immigration authority or government agency.

Service availability may vary by jurisdiction. AirSurfer may restrict or decline Services where reasonably necessary to comply with applicable licensing, registration, sanctions or regulatory requirements.

3. Flight Reservation Service

For a flight Reservation Service, AirSurfer arranges the creation and delivery of a temporary Reservation Record corresponding to the Material Itinerary Requirements of the Order.

The Reservation Record may include:

  • passenger information;

  • itinerary;

  • airline information;

  • flight information;

  • travel dates;

  • booking information;

  • PNR;

  • itinerary or reservation documentation.

3.1. A Reservation Record is not an airline ticket

Unless expressly stated otherwise, a Reservation Record:

  • is not a paid airline ticket;

  • does not constitute payment of airfare;

  • does not create a right to transportation;

  • does not guarantee boarding;

  • does not guarantee that transportation will ultimately take place; and

  • must not be represented as evidence that an airline ticket has been purchased.

AirSurfer sells the Service of arranging and delivering the Reservation Record. It does not sell the underlying air transportation unless expressly stated otherwise in a separate offering.

3.2. Third-party booking statuses

A third-party reservation system, supplier, GDS or airline may display technical booking statuses or terminology in connection with a Reservation Record.

Any such status is generated and controlled by the relevant third party.

A status displayed by a third-party system, including terminology that may indicate confirmation within that system, does not constitute a representation by AirSurfer that the traveler owns a paid airline ticket or has an unconditional right to transportation.

4. Verification

Where a Service is described as verifiable, this means that at the time of delivery the Reservation Record can be retrieved or verified using the verification method applicable to that Order.

AirSurfer does not guarantee that a Reservation Record will appear through every airline website, mobile application or third-party verification service.

Different airlines and suppliers use different reservation infrastructure and verification methods.

Failure of one particular third-party website or application to display a Reservation Record does not by itself establish that the Service was not provided.

5. Minimum Service Period and Replacement Guarantee

The Minimum Service Period begins when the initial Reservation Record is first made available to the customer.

AirSurfer does not guarantee that the same PNR, supplier, airline, flight number or other non-guaranteed booking parameter will remain unchanged throughout the Minimum Service Period.

If a Reservation Record becomes unavailable before the end of the Minimum Service Period for reasons not caused by the customer, AirSurfer may satisfy its guarantee by arranging a replacement Reservation Record.

A replacement must substantially satisfy the Material Itinerary Requirements applicable to the Order.

Unless expressly guaranteed at checkout, a replacement may use a different:

  • PNR;

  • supplier or reservation system;

  • airline or operating carrier;

  • flight number;

  • departure or arrival time;

  • booking class; or

  • other non-material booking parameter.

A change to any such non-guaranteed parameter does not by itself constitute defective performance.

The customer will be provided with updated documentation where reasonably necessary following a replacement.

A replacement does not restart or extend the original Minimum Service Period unless AirSurfer expressly agrees otherwise.

If AirSurfer cannot provide a suitable replacement or otherwise satisfy the applicable guarantee, AirSurfer will provide the remedy required under applicable law.

AirSurfer does not guarantee continued availability after the Minimum Service Period expires.

6. Accommodation Reservations

Where AirSurfer provides an accommodation reservation Service, AirSurfer arranges a reservation record with the relevant accommodation provider or supplier.

Unless expressly stated at checkout, the AirSurfer fee does not constitute payment for accommodation itself.

Accommodation charges, deposits, taxes, resort fees and incidental charges are not included unless expressly stated otherwise.

The accommodation provider remains responsible for the accommodation services it independently provides.

7. Visa and Travel-Document Assistance

Where available, AirSurfer may provide administrative assistance with visa applications, electronic travel authorizations and other travel documents.

AirSurfer does not issue visas, immigration permissions or entry authorizations.

Approval, refusal, processing time, requests for additional information and permission to enter a country are controlled by the relevant governmental or authorized body.

Any governmental processing time displayed through AirSurfer is informational unless expressly stated otherwise.

A visa refusal or governmental delay does not by itself mean that AirSurfer failed to provide its Service.

Where a specific Service includes an express refund guarantee, only the conditions of that guarantee displayed before purchase apply.

8. Intended Use

AirSurfer Services may be used only for lawful purposes.

A Reservation Record may be used to demonstrate an intended travel itinerary where such documentation is lawfully requested.

You must not use an AirSurfer document to falsely represent that:

  • airfare has been paid when it has not;

  • an airline ticket has been purchased when it has not;

  • transportation is guaranteed when it is not; or

  • the document establishes any fact that it does not actually establish.

AirSurfer does not guarantee that any document will be accepted by an embassy, consulate, visa center, immigration authority, border authority, airline, bank or other third party.

You remain responsible for determining the requirements applicable to your particular travel, application or use case.

9. Customer Information

You must provide complete and accurate information necessary for the Service.

You are responsible for checking names, dates of birth, travel-document information, travel dates, routes and other Order information before payment.

AirSurfer is not responsible for a defective result caused by inaccurate or incomplete customer-provided information.

If correction or replacement is required because of customer-provided information, an additional Service fee may apply.

If AirSurfer incorrectly processes information that you provided correctly, AirSurfer will take reasonable steps to correct the affected Service.

When providing information concerning another traveler, you represent that you are authorized to provide that information and arrange the relevant Service on their behalf.

10. Orders and Contract Formation

An Order becomes binding when:

  1. the required information has been submitted;

  2. these Terms have been accepted; and

  3. payment has been successfully completed.

The conditions displayed immediately before payment form part of the agreement.

The version of these Terms accepted when the Order is placed applies to that Order.

AirSurfer may retain electronic records reasonably necessary to establish the transaction, including Order details, Terms version, acceptance records, payment status and delivery records.

11. Immediate Performance and Delivery

AirSurfer operates through an automated fulfillment process.

You understand that performance may begin immediately following successful payment and may be completed within minutes.

The arrangement and delivery component of a Reservation Service is completed when:

  1. the Reservation Record required by the Order has been created; and

  2. the relevant result has been made available through the Website, customer account, email, link or another electronic delivery method.

The customer does not need to open, download, read or subsequently use the delivered result for delivery to occur.

The replacement guarantee described in Section 5 is an ancillary post-delivery commitment and does not require the original arrangement and delivery process to be repeated unless replacement becomes necessary.

Where mandatory consumer law requires express authorization before immediate performance may begin, AirSurfer will request that authorization separately.

12. Prices and Payment

The total amount payable to AirSurfer is displayed before payment.

Unless expressly stated otherwise, amounts paid to AirSurfer for a Reservation Service are fees for the AirSurfer Service and are not payment of airline fare.

Payments may be processed by independent payment processors.

AirSurfer generally does not receive or store full payment-card credentials.

Banks, card issuers and payment providers may impose independent currency conversion or other charges for which AirSurfer is not responsible.

13. Cancellations and Refunds

AirSurfer begins processing Orders immediately after successful payment.

Before the Service has been delivered, cancellation rights are governed by applicable law and any conditions displayed at checkout.

Where permitted by law, non-refundable third-party costs actually incurred in processing the Order may be deducted from a refund.

Once the Service has been fully and properly delivered, the Service fee is not refundable merely because the customer:

  • changes or cancels travel plans;

  • decides not to use the Reservation Record;

  • purchases another reservation or ticket;

  • decides not to apply for a visa;

  • obtains a visa without using the Reservation Record;

  • supplied incorrect information;

  • no longer requires the Service; or

  • does not use the delivered result.

Expiry after the applicable Minimum Service Period does not constitute a failure to provide the Service.

Nothing in this Section limits mandatory remedies where AirSurfer failed to provide the purchased Service or materially failed to perform the Order as agreed.

Verified duplicate payments for the same Order will be refunded.

EU, EEA and UK consumers

Where applicable law provides a statutory withdrawal or cancellation period and you request AirSurfer to begin performance before that period expires, AirSurfer may require a separate express request for immediate performance and acknowledgement of the effect that full performance may have on your statutory cancellation rights.

Mandatory consumer rights remain unaffected.

14. Third-Party Events

Airlines, reservation systems, accommodation providers, governments and other independent parties may take actions outside AirSurfer's control.

Such actions may include timetable changes, cancellations, system outages, route changes, supplier restrictions, accommodation changes and governmental decisions.

AirSurfer remains responsible for performing the Service described in the Order but does not assume responsibility for independent services or decisions of third parties except where applicable law requires otherwise.

15. Fraud, Abuse and Compliance

AirSurfer may refuse, suspend or cancel an Order where reasonably necessary to prevent:

  • fraud;

  • unauthorized use of personal information;

  • sanctions violations;

  • abuse of the Service;

  • security threats; or

  • unlawful activity.

You may not circumvent geographic, payment, security or compliance restrictions implemented by AirSurfer.

Where AirSurfer cancels an unperformed Order solely for its own compliance reasons, the payment will be handled in accordance with applicable law.

16. Payment Disputes and Chargebacks

If you believe a payment was incorrect or a Service was not provided, you may contact AirSurfer support.

AirSurfer may provide payment processors, card issuers or financial institutions with transaction information reasonably necessary to respond to a payment dispute, including:

  • acceptance records;

  • Order details;

  • payment records;

  • delivery records;

  • Reservation Records; and

  • relevant correspondence.

A chargeback does not independently alter whether a Service was contractually delivered.

Nothing in this Section limits rights available under mandatory payment or consumer law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, AirSurfer LLC will not be liable for indirect, incidental, special or consequential losses arising from matters outside the scope of the Service purchased.

To the maximum extent permitted by applicable law, AirSurfer LLC's aggregate contractual liability arising from a particular Order will not exceed the amount paid to AirSurfer for the affected Service.

These limitations do not apply where liability cannot legally be limited or excluded, including applicable liability for fraud, willful misconduct, gross negligence, personal injury or mandatory consumer remedies.

18. Events Outside Reasonable Control

AirSurfer is not responsible for delay or failure caused by circumstances outside its reasonable control where such limitation is permitted by applicable law.

Ordinary operational problems that AirSurfer could reasonably prevent or remedy are not automatically treated as circumstances outside its reasonable control.

19. Governing Law and Jurisdiction

Except where mandatory consumer law provides otherwise, these Terms and disputes relating to them are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Except where a consumer has a mandatory legal right to bring proceedings elsewhere, disputes are subject to the competent state or federal courts having jurisdiction in Wyoming.

If mandatory law applicable to a consumer grants rights or protections that cannot lawfully be waived by contract, those rights remain unaffected.

20. Changes and Severability

AirSurfer may update these Terms for future Orders.

A new version does not retroactively change the Terms applicable to an existing Order unless permitted by applicable law.

If any provision is found unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.
